Rental Agreement and Liability Waiver

Company: Beeming Jumpers & Slides
Phone: (806) 590-0737
State of Governing Law: Texas

This Rental Agreement and Liability Waiver (the “Agreement”) is entered into by and between Beeming Jumpers & Slides (“Company”) and the undersigned customer (“Renting Party”). This Agreement governs the rental of inflatable bouncers, slides, and related equipment (the “Equipment”).

1. Rental Period & Overtime Fees

Rental rates specified as “FOR THE DAY” cover a standard rental period of up to 6 (six) continuous hours. Any rental period exceeding this 6-hour duration will be subject to an additional charge of $50.00 (fifty dollars) per hour. The rental period begins when the Equipment is fully set up and turned over to the Renting Party, and ends when the Company arrives for takedown.

2. Deposit & Payment Terms

A 50% non-refundable deposit must be paid at the time of booking in order to secure the rental equipment and date. The remaining balance must be paid in full prior to or at the time of delivery and setup. Failure to pay the remaining balance will result in the immediate cancellation of the rental, and the deposit will be forfeited.

3. Liability & Assumption of Risk

RENTING PARTY ACCEPTS ALL RESPONSIBILITY AND HEREBY WAIVES ALL CLAIMS: BEEMING JUMPERS & SLIDES IS NOT LIABLE FOR ANY PERSONAL INJURIES OR PROPERTY ACCIDENTS SUFFERED DURING THE RENTAL PERIOD, FROM ANY CAUSE WHATSOEVER.

The Renting Party acknowledges that the use of inflatable amusement equipment involves inherent risks of physical injury. The Renting Party assumes all liability and responsibility for any and all injuries, damages, or claims arising out of the use of the Equipment while it is in their possession.

4. Equipment Damage, Loss & Cleaning

THE RENTING PARTY ACCEPTS FULL RESPONSIBILITY FOR ALL LOSS AND DAMAGE TO THE RENTAL EQUIPMENT AND AGREES TO REIMBURSE BEEMING JUMPERS & SLIDES IN FULL FOR ALL COSTS ASSOCIATED WITH ALL NECESSARY REPAIRS AND/OR FULL REPLACEMENT COST FOR ANY EQUIPMENT DAMAGED, LOST, OR STOLEN DURING THE RENTAL PERIOD.

Prohibited Items: The use of “Silly String”, gum, candy, food, drinks, pets, toys, sharp objects, and shoes are STRICTLY PROHIBITED in or around the Equipment. Silly String permanently damages the vinyl. If Silly String or other prohibited items are found on the Equipment, the Renting Party will be liable for the full replacement cost of the unit.

Cleaning Fee: A minimum $100 cleaning fee will be assessed if the equipment is returned excessively dirty (e.g., covered in mud, food stains, face paint, or debris).

5. Site Preparation & Delivery

  1. The Renting Party must ensure the setup area is relatively flat, clean, and entirely free of sharp objects, animal feces, rocks, and debris prior to delivery.
  2. The setup location must have a standard 110V electrical outlet within 50 feet of the Equipment.
  3. If the Company arrives and the site is deemed unsafe or unprepared, the Company reserves the right to cancel the rental, and the 50% deposit will be forfeited.

6. Safety Rules & Supervision

  1. A responsible adult (18 years or older) must supervise the Equipment at all times while it is inflated. Do not exceed the manufacturer’s recommended capacity or weight limits. Group participants by age and size.
  2. No flips, wrestling, or roughhousing. Do not bounce against the sides or near the entrance/exit.
  3. If winds exceed 15-20 mph, or if lightning or heavy rain occurs, the Renting Party must immediately evacuate all participants, deflate the unit, and turn off the blower for safety.

7. Standard Cancellation Policy

Standard Cancellation (48+ Hours Notice). We understand that plans change. If you need to cancel your reservation, you must notify us at least 48 hours prior to your scheduled delivery time. Your 50% deposit is non-refundable, but with 48 hours’ notice, we will gladly apply it as a “raincheck” credit toward any future rental within one year.

Last-Minute Cancellations (Less Than 48 Hours Notice). Cancellations made less than 48 hours before the event, or failure to be present at the time of delivery, will result in the complete forfeiture of your deposit. Because we reserved the equipment specifically for you and turned away other customers, the deposit will cover the lost booking.

Weather-Related Cancellations. Safety is our top priority. Here in West Texas, weather can change quickly. We reserve the right to cancel your reservation if severe weather (heavy rain, lightning, or sustained winds/gusts exceeding 20 mph) is forecast.

Before Delivery: If we must cancel prior to setup due to unsafe weather conditions, or if you choose to cancel before we leave our warehouse due to weather, your deposit will be issued as a rain-check for a future date.

After Setup: Once the equipment is delivered, set up, and the rental period begins, no refunds or credits will be issued under any circumstances, including sudden weather disruptions.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas. Any legal action or proceeding arising out of this Agreement shall be brought exclusively in the courts located in the State of Texas, and the parties hereby consent to the jurisdiction of such courts.

9. Pay-Over-Time Financing (Klarna, Afterpay, Affirm)

IF YOU CHOOSE TO PAY OVER TIME, THE FULL RENTAL AMOUNT IS CHARGED AT BOOKING AND THE BOOKING IS NON-REFUNDABLE.

The Company may offer pay-over-time options through third-party providers such as Klarna, Afterpay or Affirm (a “Pay-Over-Time Provider”). If the Renting Party selects a pay-over-time option at checkout, the following terms apply and take priority over Sections 2, 5 and 7 wherever they differ:

  1. Paid in full at booking. The entire rental amount, including delivery fees and sales tax, is charged at the time of booking. The 50% deposit described in Section 2 does not apply, and no balance is collected at delivery. Charges that arise during the rental — overtime hours under Section 1, and cleaning fees or damage under Section 4 — remain payable separately.
  2. No refunds. All amounts paid through a Pay-Over-Time Provider are non-refundable for any reason, including cancellations made with 48 or more hours’ notice under Section 7, and cancellations under Section 5 because the site is unsafe or unprepared.
  3. Weather cancellations by the Company. If the Company cancels before delivery because of unsafe weather, the amount paid will be issued as a rain-check credit toward a future rental within one year, as described in Section 7. No cash refund will be issued.
  4. Your financing agreement is separate. The Renting Party’s payment plan is an agreement between the Renting Party and the Pay-Over-Time Provider. Cancelling, rescheduling or changing the rental does not cancel, reduce or pause any amount owed to the Pay-Over-Time Provider. Beeming Jumpers & Slides is not a lender and does not set, collect or service installment payments.
  5. Acknowledgement. By selecting a pay-over-time option and ticking the pay-over-time acknowledgement at checkout, the Renting Party confirms they have read, understood and agreed to this Section.
